The UK Government has been updating its policy in light of Brexit and this month announced several important reforms. Below, Samantha Randall, an Associate Solicitor specialising in employment law, outlines the key changes you need to know.
1. Working Time Regulations
The Government has decided to:
- Merge ‘normal’ and ‘additional’ holiday leave into a unified entitlement, which may affect the calculation of holiday pay.
- Permit the practice of ‘rolled-up’ holiday pay, provided that the rolled-up element is clearly displayed on payslips.
- Remove the record-keeping requirement under the Working Time Regulations.

2. Transfer of Undertakings (Protection of Employment) Regulations
Another significant amendment is the decision to eliminate the obligation to consult with appointed representatives when:
- The business has fewer than 50 employees, and
- There are fewer than 10 transferees.
These changes represent a major relief for small businesses, streamlining the TUPE consultation process.
3. Sunset Clause in the Retained EU Law (Revocation and Reform) Bill
Initially, the Bill included a sunset clause that would have revoked nearly all EU law by the end of 2023 unless expressly preserved. The Government has now abandoned that clause.
Key points:
- EU law will remain binding in the UK unless specifically repealed.
- The Bill will be amended to list retained EU laws to be revoked on 31 December 2023. Any legislation not on that list will continue in force.
