What are the new day one rights for 2026?
The Employment Rights Act 2025 (enforced in 2026), introduced several immediate protections: Statutory Sick Pay (SSP) (removal of waiting days), Paternity Leave, and Unpaid Parental Leave. You also have day-one protection against dismissal for whistleblowing, union membership, and reporting health and safety issues.
Any detrimental treatment for being a Trade Union member is clearly a discrimination, this has been a day one right along with reporting health and safety issues.
The Workers of England use independent Trade Union employment reps who are separate from the employer and can therefore should not be compromised by any breaches relating to day one rights.
