The Workers of England Union is proud to confirm that, after supporting a member who was allegedly dismissed due to his English Nationalist beliefs, we have achieved recognition of English Nationalism as a conditionally Protected Characteristic under the Equality Act. Furthermore, it has been officially notified that our appeal against certain aspects of the original judgment—those which restricted our member’s rights—will proceed to the Employment Appeal Tribunal as an “A” Listed case.


Background

Our member’s case (Mr S Thomas v Surrey & Borders Partnership NHS Foundation Trust & Others, Case No. 2304056/2018; Appeal from Croydon Employment Tribunal – EA-2021-000488-AT) challenged the unlawful dismissal purportedly based on political belief. Initially, the Employment Tribunal accepted that English Nationalism could qualify as a protected characteristic, albeit conditionally.


Next Steps

We look forward to obtaining a landmark ruling that English Nationalism is unconditionally a Protected Characteristic under the Equality Act. This full hearing at the Employment Appeal Tribunal will set an important precedent for political belief protections in the workplace.
