Paul Bailey, a former ambulance operations manager, was dismissed from the NHS after declining the COVID-19 jab. A tribunal has now ruled that belief in a homeopathic lifestyle and bodily autonomy qualifies as a protected characteristic under the Equality Act.

The preliminary hearing determined that Mr. Bailey’s discrimination claim is admissible because his philosophical beliefs should be protected in the same way as religious or gender-critical views. This landmark decision means employers cannot argue that such beliefs fall outside the scope of the Act.


Case Details

Paul Bailey worked for the NHS for five years before his dismissal in December 2021. He is represented by the Workers of England Union (WEU) and solicitor Robin Tilbrook.

Both the union and Mr. Tilbrook cited the Trotman ruling, which confirmed that no legal mandate required employees to take COVID-19 vaccines to keep their jobs. This precedent suggests that similar dismissals are unlawful.


Significance for Employers and Employees

Robin Tilbrook emphasized that employers now have no defence except a strict internal vaccination policy, which only covers a small fraction of cases. He is also appealing a decision in Tribunal Upholds Homeopathic Lifestyle and Bodily Autonomy, aiming to close any remaining loopholes.

Stephen Morris of the WEU added, “This is the first ruling confirming that homeopathy and bodily autonomy are protected. We expect a clear win for Mr. Bailey, given that the law never required firings for vaccine refusal.”


Broader Impact and Related Actions

Following this judgment, other workers fired for refusing COVID-19 vaccines are pursuing class actions against the government and direct claims against employers. Last November, Maurice Trotman won £12,000 after a judge found his dismissal unlawful under the same reasoning.

Under the now-withdrawn Vaccination as a Condition of Deployment policy, an estimated 40,000 social care workers left their roles. The policy was halted and guidance withdrawn by March 2022.


Looking Ahead

This ruling marks a turning point for workplace rights, affirming that philosophical beliefs—including homeopathy and bodily autonomy—must be accommodated under UK law. Employees dismissed for such beliefs now have a clear path to challenge unfair dismissals.
