Updated Paternity Leave Regulations

Updated Paternity Leave Regulations

| W.E.U Admin | Workplace Wellbeing

On 8 March 2024, the Paternity Leave (Amendment) Regulations 2024 will come into effect, resulting in significant changes to paternity leave rights in the UK.

Key Changes

  • Split Leave Periods: The two-week paternity leave entitlement can now be taken in two non-consecutive one-week blocks, rather than a single block of one or two weeks.
  • Extended Window: Leave may be taken at any point within 52 weeks after birth or adoption, replacing the previous 8-week limit.
  • Notice Period: Employees must give 28 days’ notice of their intention to take paternity leave, instead of the prior notice requirement of 15 weeks before the expected week of childbirth (EWC).
  • Flexible Date Changes: Once initial notice is given, employees can vary dates by providing a further 28 days’ notice.

Scope of the Regulations

These amendments apply when:

  • The EWC is after 6 April 2024.
  • The expected placement date for adoption is on or after 6 April 2024.
  • The expected entry date into Great Britain for adoption is on or after 6 April 2024.

Eligibility

Eligibility for both paternity leave and pay remains unchanged and is restricted to employees.
